What Is Premises Liability Insurance?

Premises liability insurance is liability coverage that may respond when someone alleges that a dangerous condition on insured property caused an injury. The coverage is often part of a homeowners policy or commercial general liability policy rather than a separate policy with that exact name. Examples can include slip-and-fall accidents, unsafe stairs, falling objects, inadequate maintenance, or other property-related hazards. Whether a claim is covered depends on the policy language, location, exclusions, limits, and circumstances of the accident. Insurance coverage and legal liability are separate questions. A property owner can have insurance even when they were not negligent, and an insurer can dispute coverage even when an injury occurred. In a premises liability case, investigators may examine how long the hazard existed, whether the owner knew or should have known about it, warnings, inspection procedures, and the injured person’s own actions.
