What Are Civil Rights Violations?

Civil rights violations occur when rights protected by the Constitution or federal or state law are unlawfully infringed. Depending on the circumstances, claims can involve discrimination, unlawful arrest, excessive force, violations of free speech or religious rights, denial of due process, unlawful searches, voting rights violations, or discrimination in employment, housing, education, and public accommodations. Not every unfair or harmful act is legally a civil rights violation. A valid claim requires a specific protected right, a legally responsible person or organisation, and facts satisfying the relevant statute or constitutional standard. Claims against government officials can involve special doctrines, including qualified immunity and specific procedural requirements. Different civil rights statutes also have different filing deadlines and administrative prerequisites. Someone who believes their civil rights were violated should document what happened, preserve communications and recordings where lawful, identify witnesses, and obtain legal advice promptly because some claims have relatively short deadlines.
