5 stars

A woman is dead after attempting to cross I-495 in Oxon Hill, Maryland, after crashing a carjacked vehicle on February 1.

According to the Maryland’s attorney general office, police officers found a vehicle that was carjacked earlier that day in a shopping center’s parking lot in the 6000 block of Oxon Hill Road.

A woman got into the vehicle and started driving, according to the Prince George’s County Police. Officers attempted to stop the vehicle.

After failing to stop, the woman crashed into the rear of the parking lot. She left the vehicle and attempted to cross I-495 on foot, according to the police.

While attempting to cross the busy interstate, she was struck by at least one, possible two vehicles not involved in the police chase. She was pronounced dead on the scene.

Fatal Pedestrian Accidents in Maryland

This tragic incident highlights several critical legal and safety issues that often arise in complex traffic accidents. From a legal standpoint, multiple factors come into play when analyzing liability and potential claims in such cases.

In Maryland, even when a pedestrian is crossing illegally, drivers still maintain a duty of care to avoid accidents when possible. This creates a complex legal scenario where multiple factors must be examined, including:

  • The visibility conditions at the time of the accident
  • The speed and reaction time of the vehicles that struck the pedestrian
  • Whether the drivers had a reasonable opportunity to avoid the collision
  • The impact of the police pursuit on the overall chain of events

This incident also underscores the inherent dangers of pedestrian attempts to cross high-speed interstates like I-495, where pedestrian access is prohibited specifically because of the extreme risks involved. The Capital Beltway’s heavy traffic flow and high speeds make such attempts particularly hazardous.

For families involved in similar tragic incidents, it’s important to understand that Maryland follows the contributory negligence doctrine, one of the strictest in the nation. Under this rule, if a person is found to be even partially at fault for their injuries, they may be barred from recovering damages.

If you lost a loved one in a pedestrian accident anywhere in Maryland, contact a Maryland pedestrian accident attorney to understand your rights and what you and your family should do going forward.
