What If My Medical Bills Are More Than My Settlement?

If your medical bills exceed your personal injury settlement, the settlement does not automatically erase the remaining balances. What happens depends on who paid the bills, whether providers have liens, the terms of your health insurance, applicable reimbursement rights, and state law. Before accepting a settlement, your lawyer should identify outstanding medical bills and liens and calculate how much money will remain after fees, costs, and required repayments. In some cases, medical providers, insurers, or lienholders may agree to reduce what they are owed, particularly when available settlement funds are limited.
