When a loved one dies in a Maryland traffic accident, families have two legal options: wrongful death claims and survival actions. Wrongful death claims are filed by immediate family members seeking compensation for their own loss, while survival actions are brought by the deceased’s estate for the suffering experienced by the victim before death.
Insurance coverage often limits compensation in fatal accident cases, with Maryland’s minimum liability coverage being only $30,000. However, experienced attorneys can sometimes find additional coverage sources to provide fair compensation.
As of recent years, non-economic damages (such as pain and suffering) in Maryland wrongful death cases are capped, with the amount increasing by $15,000 annually.
Family members must file wrongful death lawsuits within three years of the date of death.
Getting proper legal representation quickly is crucial, as evidence needs to be preserved and statutory deadlines must be met to protect your rights to compensation.
