Pedestrian Accidents in Virginia: Understanding Your Legal Rights

Every year, hundreds of pedestrians are struck by vehicles on Virginia roads, resulting in serious injuries and fatalities. These accidents often leave victims and their families facing overwhelming medical bills, lost wages, and long-term rehabilitation costs.

The Scope of the Problem

Pedestrian accidents in Virginia most commonly occur in urban areas like Arlington, Alexandria, and Richmond, particularly at intersections and in shopping districts. Contributing factors typically include:

  • Distracted driving
  • Failure to yield at crosswalks
  • Speeding in residential areas
  • Poor visibility during dawn/dusk hours
  • Improper turns at intersections

Your Legal Rights as a Pedestrian

Virginia law provides specific protections for pedestrians. Drivers must yield to pedestrians in marked crosswalks and exercise due care to avoid colliding with any pedestrian on the roadway. However, Virginia also follows the “contributory negligence” rule, which can significantly impact your case.

Critical Legal Steps After a Pedestrian Accident

If you or a loved one has been injured as a pedestrian:

  1. Seek immediate medical attention, even for seemingly minor injuries
  2. Document everything – take photos of the accident scene, injuries, and collect witness information
  3. File a police report to create an official record of the incident
  4. Avoid discussing fault with insurance adjusters or signing any documents
  5. Consult with an experienced personal injury attorney as soon as possible

The Contributory Negligence Challenge

Virginia’s contributory negligence law means that if you are found even 1% at fault for the accident, you may be barred from recovering compensation. This makes professional legal representation crucial to protect your rights.
