District of Columbia Laws & Statutes

General Rules (apply to most injury claims)

Three-year deadline to sue. Most DC personal injury claims must be filed within 3 years. Β Waiting can bar your case. D.C. Code Β§ 12-301(8).

Pure contributory negligence. The District of Columbia follows the common-law doctrine of pure contributory negligence, which bars recovery if a plaintiff is even one percent at fault. Β However, under D.C. Code Β§ 50-2204.52, pedestrians and other β€œvulnerable users” may recover so long as their negligence is less than that of the driver.

Wrongful death. The personal representative brings wrongful-death claims on behalf of statutory beneficiaries. Families cannot sue directly; the estate does. D.C. Code Β§Β§ 16-2701 to 16-2703.

District of Columbia Tort Claims Act (D.C. Code Β§Β§ 2-401 et seq.) β€” allows people to sue the D.C. government for injuries or deaths caused by the negligence of its employees while they’re doing their jobs, as long as the claimant gives written notice within six months as required by Β§ 12-309.
