According to the complaint, the parking meter attendant had gotten out of the van to write a ticket. The attendant left the van in gear with the keys in the ignition. As a result, the van began to roll down the hill. It accelerated for over a block before jumping the curb and hitting the victim as she was about to enter the Warner Theatre to watch her daughters perform in The Nutcracker.
As a result of the impact, the woman suffered three fractured vertebrae.
Despite having immediately been aware of the cause of the incident, the DC government refused for almost five years to accept responsibility. Only when the victim had forced it to the eve of trial did the DC government even admit fault; even then, it continued to attempt to minimize the severity of the victim’s spinal injuries.
