Rollover accidents represent some of the most dangerous and potentially devastating types of motor vehicle crashes that occur on Maryland’s roadways. These accidents, which often happen on highways like I-95, I-70, and the Baltimore Beltway, can result in catastrophic injuries due to the violent nature of a vehicle flipping over and the subsequent roof crush that may occur.
In Maryland, several factors commonly contribute to rollover accidents. The state’s varied terrain, including the winding roads of western Maryland and the busy urban corridors around Baltimore and Washington DC, can increase rollover risks, particularly for top-heavy vehicles like SUVs and pickup trucks. Weather conditions, such as the winter weather and high winds, can also play a significant role when combined with excessive speed or sudden steering maneuvers.
From a legal standpoint, Maryland follows the contributory negligence doctrine, which can significantly impact personal injury claims arising from rollover accidents. Under this strict rule, if an injured party is found to be even 1% at fault for the accident, they may be barred from recovering compensation. This makes it crucial for victims of rollover accidents to thoroughly document the accident scene, gather witness statements, and work with accident reconstruction experts to establish clear liability.
Personal injury victims in rollover accidents often face severe injuries including traumatic brain injuries, spinal cord damage, crushing injuries, and multiple fractures. These injuries typically require extensive medical treatment, lengthy rehabilitation periods, and can result in permanent disabilities. The financial impact can be substantial, encompassing not only immediate medical expenses but also long-term care needs, lost wages, and diminished earning capacity. Maryland law allows victims to seek compensation for both economic and non-economic damages, including pain and suffering, though non-economic damages are subject to a statutory cap that adjusts annually.
