Hit and run accidents present unique challenges for victims in Fairfax County, Virginia. When a negligent driver flees the scene of an accident, injured parties face not only physical and emotional trauma but also complex legal hurdles in seeking compensation.
Under Virginia Code §46.2-894, drivers involved in accidents resulting in injury or property damage must stop as close to the scene as possible. They’re legally required to provide their name, address, driver’s license number, and vehicle registration to the police, injured parties, or passengers of the affected vehicle. Failing to fulfill these obligations constitutes a “hit and run” offense with serious legal consequences.
For personal injury victims, hit and run accidents create additional complications. When the responsible party flees, it becomes challenging to determine fault and identify who should be notified about damages. Unlike typical accidents where two parties exchange information and their respective insurance companies determine liability, hit and run cases often require alternative approaches to compensation. This is where understanding your insurance coverage becomes vital.
Many auto insurance policies offer personal injury coverage, collision coverage, or uninsured motorist coverage that may compensate for injuries or property damage caused by hit and run drivers. However, not all policies provide this protection, making it essential to verify your coverage before filing claims. An experienced Fairfax County car accident attorney can help navigate these complex insurance issues while advocating for your rights.
